Agreement to Terms

By accessing and using the services of Keep Hammering Construction ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Description of Services

Keep Hammering Construction provides residential remodeling and light construction services, including but not limited to:

• Kitchen remodeling and renovation
• Bathroom remodeling and renovation
• Basement finishing
• Home additions
• Whole-home remodeling
• Outdoor living spaces
• Custom carpentry
• Aging-in-place modifications

Service Area

Our services are primarily available in Northern Colorado, including Loveland, Fort Collins, Greeley, Windsor, Severance, and surrounding areas. Service availability outside these areas will be determined on a case-by-case basis.

Consultation and Estimates

• Initial consultations are provided free of charge
• Estimates are provided in good faith based on information available at the time
• Final project costs may vary based on actual conditions discovered during work
• All estimates are valid for 30 days unless otherwise specified

Project Agreements

All construction projects require a separate written contract that will include:

• Detailed scope of work
• Materials specifications
• Project timeline
• Payment terms and schedule
• Change order procedures
• Warranty information

Payment Terms

• Payment schedules will be outlined in individual project contracts
• We may require deposits before beginning work
• Final payment is due upon project completion and your satisfaction
• Late payments may be subject to interest charges as specified in contracts

Permits and Compliance

• We will obtain necessary permits for work as required by local codes
• All work will be performed in compliance with applicable building codes
• Permit costs are typically included in project estimates unless otherwise noted

Insurance and Licensing

• Keep Hammering Construction is fully licensed and insured
• We carry general liability and workers' compensation insurance
• Proof of insurance can be provided upon request

Warranties

• We provide warranties on our workmanship as specified in individual contracts
• Material warranties are provided by manufacturers
• Warranty terms will be clearly outlined in project agreements

Limitation of Liability

Our liability is limited to the value of the services provided. We are not liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount paid for our services.

Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to natural disasters, government actions, material shortages, or other unforeseeable events.

Intellectual Property

• All designs and plans created by us remain our intellectual property
• You receive a license to use designs for your specific project
• Our company name, logo, and branding are protected trademarks

Privacy and Confidentiality

We respect your privacy and will keep project details confidential. Please refer to our Privacy Policy for information about how we handle your personal data.

Dispute Resolution

Any disputes will first be addressed through good faith negotiations. If resolution cannot be reached, disputes will be resolved through binding arbitration in Colorado under the rules of the American Arbitration Association.

Termination

Either party may terminate a project agreement under the terms specified in the individual contract. Termination procedures and any applicable fees will be outlined in project agreements.

Website Use

• Our website is for informational purposes and to facilitate service inquiries
• You may not use our website for any unlawful purpose
• We reserve the right to modify or discontinue website features at any time

Governing Law

These Terms are governed by the laws of the State of Colorado. Any legal proceedings will be conducted in the appropriate courts of Colorado.

Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last updated" date. Continued use of our services constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
